These Terms of Use ("Terms") constitute a legally binding agreement between you, either as an individual driver or as a transportation company (collectively referred to as "Service Provider"), and Bdriver, Inc. ("Bdriver"). These Terms govern your access to and use of Bdriver's platform and services as an independent contractor providing transportation services ("Driver Services"). By accepting these Terms, you represent and warrant that you meet all driver requirements set forth by Bdriver and applicable laws and regulations. Your continued use of the Driver Services indicates your ongoing agreement to these Terms, which may be updated from time to time at Bdriver's discretion.
1)TRANSPORTATION NETWORK COMPANY AND TNC DRIVER INSURANCE REQUIREMENTS.

2) Use of Bdriver Platform
You may only use the Bdriver platform and Driver Services to receive trip requests and provide transportation services. Unauthorized use or activities like street hails are prohibited.
3) App Stores
The availability of the Services may be dependent on the third-party from which you received the license to the Bdriver App, e.g., the Apple iPhone or Android app stores (“App Store”). These Terms are between you and Bdriver and not with the App Store and Bdriver is responsible for the provision of Services as described in these Terms. However, if you downloaded the Bdriver App from the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple shall have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof. These Terms incorporate by reference Apple’s Licensed Application End User License Agreement, for purposes of which, you are the “end-user.” In the event of a conflict in the terms of the Licensed Application End User License Agreement and these Terms, these Terms will control.
4) Tools
As a Bdriver partner driver, it's important that you understand our policy regarding tolls:
By accepting these terms, you agree to adhere to Bdriver's toll policy, ensuring a transparent and hassle-free experience for our passengers.Remember: Never request additional toll payment from passengers, as this is already included in the fare they pay through the app. The amount you receive for the trip already covers all costs, including tolls.
5) Fares and Pricing
At Bdriver, we strive to provide fair and transparent pricing for both our passengers and drivers. Here's how our fare calculation works:
Remember, while fares are estimated, they are designed to fairly compensate you for your time and the use of your vehicle. The different rates for each vehicle category reflect the varying costs and expectations associated with different types of rides.By accepting these terms, you acknowledge understanding of Bdriver's fare calculation method and agree to accept the fares generated by our system for each completed ride.
6) Payments and Fees
Bdriver charges a service fee on transportation fares. You are responsible for applicable taxes and fees.
At Bdriver, we prioritize transparency in all our operations. Here's how it works:
1. The amount you, as a driver, see in the app is exactly the price the passenger paid for the ride. You have visibility of 100% of the amount paid for each ride.
2. The 20% service fee is calculated based on this total gross ride revenue.
3. This 20% fee is automatically deducted and allocated to Bdriver.
4. The remaining 80% will be deposited directly into your account within 2 business days.
Our goal is always to maintain maximum transparency, ensuring that you have a clear view of your earnings and how the payment system works.
7) Restricted Activities
Accepting street hails, cash rides, or soliciting passengers outside the Bdriver platform violates these Terms and Florida law. Violations may result in account deactivation.
8) Airport and Seaport Regulations
Airports requires drivers using Bdriver at the airport to follow airport rules and regulations. Failure to follow these rules and regulations may result in the airport suspending your access to airport trips.
As a reminder, airports requires that the Bdriver decal should be displayed on the front passenger windshield facing outward, that drivers be online at all times while they are in the staging area. Drivers should not leave phones unattended in the staging area. The airport requires all drivers to comply with any direction given from airport personnel. You may be asked to show your waybill. Ground transportation and security staff: Airport and Seaport rules are as important as traffic rules. Drivers must be follow the instructions of the security staff.
9) Indemnification
You agree to indemnify Bdriver from any claims arising from your provision of services or platform use.
10) Termination and Dispute Resolution Process :
Bdriver Inc. may deactivate your account for any violation of these Terms or applicable laws. However, prior to any deactivation, Bdriver will listen to the driver's version of the complaint made by the passenger, ensuring that the driver has the opportunity to explain their side before any action is taken in favor of the passenger. This approach demonstrates a commitment to fairness and equity in the treatment of drivers, ensuring that both sides of any dispute are considered before a final decision is made.
Bdriver collects personal and vehicle information from drivers for account creation, eligibility verification, insurance purposes, and to comply with legal requirements. This data is used to facilitate transportation services, process payments, communicate with drivers, enforce these Terms, and improve services. Driver information may be shared with third parties as required to provide the services and permitted by law. Bdriver implements security measures to protect driver data and provides data rights like access and correction. This Privacy Policy is governed by Florida law.

Overview

1) Accounts and Eligibility
You must be at least 18 years old and able to form legally binding contracts to use the Rider Services. You agree to provide accurate information when creating your account.
2) Service Description
Bdriver provides mobility services by connecting you with independent contractor drivers ("Drivers") for transportation to destinations of your choice. Drivers provide transportation services, not Bdriver.
3) Payment
You agree to pay all applicable fees and charges for the Rider Services, including any tolls or surcharges incurred during your ride. Fees are calculated based on time and distance for each ride.
4) Wallet Credits and Usage
Upon downloading and registering with the Bdriver app, new users will receive a one-time credit of $50 in their Bdriver digital wallet. This credit is provided as a promotional offer to introduce users to our service. The following terms apply to the use of these wallet credits:

5) Gratuity
Except for amounts provided by you through the Services as part of the “tip” feature, Bdriver does not designate any portion of your payment as a tip or gratuity to a Third-Party Provider. You understand and agree that, while you are free to provide additional payment as a gratuity to any Third-Party Provider who provides you with services or goods obtained through the Service, you are under no obligation to do so.
6) Damage, Cleaning, Lost and Found, and Charges for Violation of Terms
Bdriver may charge you a fee on behalf of Third-Party Providers if, during your use of the Services, you have caused damage to a vehicle or property that requires repair or cleaning (“Repair” or “Cleaning”). The amount of such fee shall be determined, in Bdriver’s sole discretion, based on the type of damage and the severity. Bdriver reserves the right to verify or otherwise require documentation of damages prior to processing a fee. In the event that a Repair or Cleaning request is verified by Bdriver in Bdriver’s reasonable discretion, Bdriver reserves the right to facilitate payment for the reasonable cost of such Repair or Cleaning using your payment method designated in your Account. Such amounts, as well as those pertaining to lost and found goods, will be transferred by Bdriver to a Third-Party Provider, if applicable, and are non-refundable. Additionally, if you fail to comply with these Terms, you may be responsible for Charges, including without limitation, for transactions that could not be completed properly, arising out of or in connection with your failure to comply with these Terms.
7) Your Responsibilities
You may only use the Rider Services for legal purposes. You agree not to violate any third-party rights or use the services for prohibited commercial purposes. You are responsible for your conduct and content.
8) Termination
Bdriver may temporarily or permanently revoke your access to the Rider Services for any violation of these Terms or applicable laws. Governing Law These Terms are governed by the laws of the State of Florida.

You can access, correct or delete your data by contacting Bdriver. This Privacy Policy is governed by Florida law.
